View Full Version : Attacked on New years eve

My friend and I went to a nightclub in Leicester on the New Years Eve. Everything was fine until a fight broke out between my friend and somebody else. I tried to stop them but was also punched in my face and fall down. When I stood up I saw my friend on the floor bleeding from his lips and with a black eye. The security guard came immediately and threw the other guy out of the nightclub. My other friend and I were told by the security guard to hold my friend arms on our shoulders (who were assaulted) and take him out from the nightclub. So now the main parts start. When we came out we saw a police officer and went to her and asked her for help she didn’t react immediately so we thought we need to catch this guy by ourselves. I took my jacket off which was really dirty and ran after him and the other friend with me also. He was on the footpath and I ran from the street, between me and this guy who assaulted my friend was a fence. I tried to grab him and the police thought I’m going to punch him and arrested us all. My friend, assaulted friend, the other guy and me.
My friend has received the most harm or loss the guy who assaulted him were not touched from us, but the police is thinking I tried to fight with him. I have been interviewed and released on bail but must go back to Leicester police station in February.
Could any give me some information what will happen as this is the first time we all were arrested and nobody from my friend also myself don’t have any previous criminal history. Do you think that the police will charge me for an public order offence? Nothing happened to this guy.

What I can say is u did contact a police officer right? do you know the time and the place you contact that officer for help? if you do know u can ask them to find out who was on duty at that time and place. and the biggest mistake u did was going behind this guy.
Damian, he was running away and the police said in the interview to me that " he was running away and we caught him later on". Nothing physically happened to this guy.
It was the same police officer that arrested us. Well, we weren't violent and didn't try to run away. They just thought we are going to fight with him but we all said in the interview we were trying to catch him and not punch him.
What would you advice? Any expirience what will happen? will they charge us or release us without charges?
you said you caught this guy right? If at all the police did not come at that time what will you do to this guy? Will it be a fight again?
They may charge you a small amount of fine
Damian, I said to the police and also saying it to you
1. If I wanted to fight with him then I wouldn't try to keep my friend and the other guy away from each other in the nightclub. I would go to him and start fighting with him.
2. When I came out of the nightclub I tried to seek help from the police. I stood there and pointed my finger to this guy, but the police were not moving and trying to stop him. If I wanted to fight with this guy then I would straight run after him and jump on him and start punching. I woudln't try to involve the police and then start fighting in front of the police.
3. As I said there was a fence between him and me and I could straight run to him and jump and start punching.
Our intension was not to start a fight it was just only that the police should catch him as he was trying to run away.
when they arrested you by law they have to tell you for what reason they are arresting you. did they tell you?
Yes it was something with section 3. Sorry but I don't have much knowledge about this law as I had never to do something with this. I think I was suspicious for starting a fight.
Jason, you said "may". Is there also a possibility that they will release me without charges?

First welcome to crimeforum. Well sad to hear about you and your friends ordeal on New years Eve. It's a bit unusual that the security guards from the nightclub didn't call the police, specially if someone is hurt inside their nightclub. I do agree with Damian that the wrong thing you did was to run after this guy. Yeah maybe your intention is just to catch him but if the police didnt come maybe another fight will start and get worst. It might not be you but the other guy might start it and because there is three of you it will look like that you and your friends assaulted him. And of course as human reaction you will try to defend yourself if this guy start to assault you. Well you can make a complaint against the police who you asked for help and just ignore you. Another thing i just want to clarify where you and your friends drunk at the time of the incident? Because if you do then there is grounds that the police can charge you of trying to assault this guy due to intoxication of alcohol. Unless you and your friend can proved that you didnt start the fight and your friend is the one who was been assaulted then you dont need to worry about being charged of anything. You can go to London Borough Council Services who will be able to help you or direct you to other services who can look into your situation. You can counter charge the police for not attending to your complaint and charge the other guy of assault. Hope everything will be sorted for you and your friends.

Well, I had 1 pint of lager at this night and my friend had about 2 glasses of whiskey. Our behavior was very peaceful at this night. We didn’t argue with the police at all or tried to be violent. Did exactly what they wanted us do to and also went with them without any problems.
Well, the guy started to assault my friend inside the nightclub and I don’t know the reason until yet. I tried to stop them but also caught about two punches and was on the floor. When I stood up then my friend was on the floor with blood on half of his face. He was faint for some time. I have attached a small drawing showing where I came out and sought police help and when there was no reaction I had to run all the way down and then once again up to get to this guy. My run way shown in red.
I also asked for police help straight away when I came out of the main entrance but unfortunatly no help!

Well if you followed all the instruction of the police officer then you should not worry. But it is still best to follow up your complaints against the police officer who ignored you and the guy who punched your friend. I wish that everything will fall into right places for you and your friends. Keep us posted.

I have received a letter from the police stating that my police bail have been canceled and I'm not required to attend. However, they also said that their investigation still ongoing and if required they will notify me to attend. My other two friends have also received a letter but in theirs it says that they are released without charges and the case is over.
As I have heard it's very unlikely that they call me once again. Does somebody know about that more?

I don’t understand how come in your letter they say the case in still on going And in your friends letter they say its close? Or may be I got it wrongly?
